Plant Variety Rights
Plant Breeders Rights are a form of intellectual property designed specifically to protect new varieties of plants. The holder has the sole authority to use the protected variety consisting of the right to exploit the propagating material of such variety as follows:
- production or reproduction (multiplication)
- selling or other marketing
- conditioning for the purpose of propagation
- offering for sale
- exporting/importing
- stocking for any of the purposes mentioned above
The holder may provide his consent to a third person for the use of the protected variety ("the license"). The license is provided in writing and must include an agreement on the license charge. The plant variety rights may be granted to the variety which satisfies conditions of novelty, distinctness, uniformity and stability and has an approved denomination.
