Division of Seed and Planting Materials

Legislative Specification for the Work of the Division of Seed and Planting Materials

In addition to the Act No. 147/2002 Coll. on the Central Institute for Supervising and Testing in Agriculture (CISTA), and on the amendments to some connected Acts, as last amended, the activity of the Division of Seed and Planting Materials is delimited by the Act No. 219/2003 Coll. on marketing of seeds and planting material and on the amendments to some Acts (the Act on marketing of seeds and planting material), as last amended, and by further special Acts of the Czech Republic and by legal regulations of the European Communities related to certification and inspection of seeds and planting materials of cultivated plants, protection of plant variety rights, handling of genetically modified organisms and products and ecological agriculture. 

Propagating material of agricultural species, of vegetables, seed of fruit and ornamental species and vegetable planting material are subject to the competence of the Division of Seed and Planting Materials.

Activities of the Division of Seed and Planting Materials

It performs the certification procedure within the scope of the Act, namely

  • propagating crops certification, including further necessary examinations and it issues documents of certification or rejection of propagating crops;
  • seed and planting materials certification, including sampling and laboratory testing, and it issues documents of certification or rejection of propagating crops;
  • it keeps records of and checks the use of official labels, by means of which packages of seeds and planting materials are marked;
  • it keeps files related to the certification procedure.

It performs all the activities connected with authorization and filing of imported seed and planting materials within the scope of the Act, namely

  • it authorizes the import of seed and planting materials;
  • it keeps files related to the authorization of import;
  • it keeps records of imported seed and planting materials notified by suppliers.

It registers and keeps records of suppliers within the scope of the Act, by deputy of the Ministry, it keeps and administers the “Unified Register and Records of Persons Dealing with Plant Commodities”. It provides the data to the state administrative bodies which participate in the register.

It registers and checks seed mixtures within the scope of the Act.

It authorizes and keeps records of the use of commercial seed within the scope of the Act.

It performs issuing of labels and checks of seed of not officially listed varieties, for which authorization to be placed on the market has been granted, within the scope of the Act.

It performs accreditation of persons and preparation of contracts for partial operations at the certification procedure within the scope of the Act, namely

  • it accredits persons to field inspections of propagating crops and to issue documents for those crops, to sampling and to laboratory testing of seeds including the issue of documents;
  • it suggests suspension of an accredited person;
  • it performs both introductory and periodical training of those persons and verification of professional knowledge within the range of the accreditation in question;
  • it issues accreditation documents and keeps files related to accreditation of persons;
  • it prepares and submits to the Institute director drafts of contracts or avoidances of contracts for partial operations at certification procedure, it performs both introductory and periodical training of persons applying for and already contractual ones and verification of professional knowledge within the range given by the contract;
  • keeps records of all the accredited and contractual persons and it collaborates with them continuously.

It performs checking within the scope of the Act, namely

  • the checking of seed and planting material placed on the market, including the places where the seed is stored, processed or transported;
  • post-control of standard seed including quality verification by means of laboratory testing or field trials;
  • post-control of vegetable planting material including possible sampling to verify its quality;
  • official supervision and post-control of accredited and contractual persons;
  • random checking of imported seed;
  • checking of conventional seed and planting materials for the presence of GMO admixtures, including sampling.

It performs laboratory testing within the scope of the Act, namely

  • it performs laboratory testing within the certification procedure and checking of seed and planting material;
  • it organizes interlaboratory comparative tests to ensure the quality control of the work of accredited persons and of the Division’s laboratories;
  • it verifies new methods for testing of seed and planting materials, and puts it into practice, it issues and amends standard operating procedures and it ensures its use within the Institute and by the accredited persons.

It participates in the permission to market seed of lower quality on the basis of the Commission Regulation (EC) No 217/2006 and on the basis of the Ministry approval.

It keeps and publishes the database of seed suitable for use in organic production on the basis of the suppliers’ information.

It fulfils tasks imposed by the founder resulting from the activity of the OECD organization regarding seed certification, namely

  • it prepares materials for amendments to The OECD List of Varieties Eligible for Certification;
  • it participates in amendments to the OECD Seed Schemes;
  • it certifies seed according to valid schemes, including carrying out of obligatory field trials, it prints and issues the OECD labels and certificates.

It performs the activities associated with the membership of the International Seed Testing Association (ISTA), namely

  • it carries out laboratory testing according to the ISTA Rules;
  • it certifies seed, prints and issues the ISTA labels and certificates;
  • it takes part in the ISTA activity, including verification and comment proceedings to drafts of new methods;
  • it participates in the ISTA proficiency tests.

It performs the training, expert, supervisory and informative activity in the seed sphere within the scope of the Act, namely

  • expert trainings of the Division staff;
  • expert trainings of accredited and contractual persons according to the nature of the accreditation granted or the contract concluded;
  • it performs the supervisory and expert activity and it issues expert opinions on the basis of the findings done;
  • it performs the informative activity in the sphere of seed inspection through scientific press, the Division’s information materials and personal contact with agricultural praxis;
  • it collaborates with further state administrative bodies, with universities and research institutes.

It participates in legislative activity, namely

  • it prepares materials for creation of seed legislation and it takes an active part in its formation;
  • it gives comments to other legislative regulations associated with seed sphere.

It represents the Czech Republic in EC bodies, it takes part in preparation of the European legislation, it collaborates with certification bodies of the other EC member states and the third countries.
