Emergency measures are taken in accordance with paragraph 76 second sentence of subparagraph 2 and 76 (2) no. a) of the Act No. 326/2004 Coll., on phytosanitary care and on amendments to certain related acts, as amended, by legal act about emergency phytosanitary measures that are called “Regulation of the ÚKZÚZ”. The regulation of the ÚKZÚZ is announced by publishing on the public noticeboard of the Ministry of Agriculture of the Czech Republic and the ÚKZÚZ for a period at least 15 days and shall be published without delay in a way allowing long-range access. Other possible ways how to announce the regulation of the ÚKZÚZ are in regional or national press and in radio or television broadcasting. The regulation of the ÚKZÚZ comes into force and effects from the day of its announcement; the date of its announcement is the same as the date of its publication on the public noticeboard of the Ministry of Agriculture of the Czech Republic.
ÚKZÚZ orders these measures based on the EU phytosanitary legislation that have usually form of "Commission Decisions" more precisely "Commission Implementing Decisions". Measures are time-limited (for a year or several years, usually until they are incorporated into the EU basic phytosanitary legislation and becomes permanent or until these measures are not considered necessary).
Previously announced phytosanitary measures are also valid in the form of "Regulations of the State Phytosanitary Administration", respectively in the form of "Decision of the State Phytosanitary Administration”.
